Playlist Sensei End User Agreement

Effective Date: April 28, 2025

Welcome to Playlist Sensei ("we", "us", "our"). This End User Agreement ("Agreement") governs your access to and use of our website and services (collectively, the "Service"). By accessing or using the Service, you ("User", "you") agree to be bound by this Agreement. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 18 years old and legally able to form a binding agreement to use Playlist Sensei. By using the Service, you represent and warrant that you meet these requirements.

2. License and Use

Subject to this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes.

You may not:

• Use the Service for any unlawful purpose.
• Attempt to decompile, reverse engineer, or otherwise access the source code.
• Sell, resell, or commercially exploit the Service without our express written permission.
• Circumvent or breach any security or authentication measures.

3. User Content

You are solely responsible for the content (including tracks, playlists, and other materials) you submit or share through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your User Content solely for the purpose of providing the Service.

You represent and warrant that you have all rights necessary to submit the User Content and that it does not violate any third-party rights or any applicable laws.

4. Compliance with Spotify's Rules

Playlist Sensei integrates with the Spotify API and complies with Spotify’s Developer Terms of Service and guidelines.

• Users must not offer or accept payments, bribes, or other incentives in exchange for playlist placements ("payola").
• All playlist additions must be voluntary and based solely on the curator’s discretion.

5. Privacy

Your privacy is important to us. Our use of your personal information is governed by our Privacy Policy. Please review it carefully.

6. Disclaimers

The Service is provided "as is" and "as available," without warranty of any kind, express or implied. We do not guarantee that the Service will be error-free or uninterrupted.

We are not responsible for Spotify's platform functionality or any third-party services connected to the Service.

7. Limitation of Liability

To the fullest extent permitted by law, Playlist Sensei and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any conduct or content of any third party on the Service

8. Termination

We may suspend or terminate your access to the Service at any time, without notice, if you violate this Agreement or otherwise engage in activities that we deem harmful to the Service or other users.

Upon termination, your right to use the Service will immediately cease.

9. Changes to This Agreement

We reserve the right to update this Agreement from time to time. When we do, we will revise the "Effective Date" above. Your continued use of the Service after any changes constitutes your acceptance of the new terms.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
